Before you even get a chance to read the headline, you’re greeted by:<\/p>\n\n
Accept All. Reject. Customize. Statistics. Marketing. Preferences. <\/strong><\/p>\n\n It has become so common that it’s easy to think that all websites are required to have a cookie banner.<\/p>\n\n But that isn’t necessarily the case.<\/p>\n\n The key point is not whether you have a website<\/strong>.<\/p>\n\n What matters most is what the website does<\/strong>.<\/p>\n\n Cookies and similar technologies can be used for many different purposes.<\/p>\n\n Some are necessary for the website or a specific feature to function. These might include, for example, a login, a shopping cart, or a setting that the user has selected. <\/p>\n\n Others are used for statistics, tracking, advertising, or personalization.<\/p>\n\n According to the Danish cookie guidelines, the use of cookies and similar technologies generally requires consent when they are not technically necessary. Technically necessary technologies, on the other hand, may be used without consent when they are used solely for the necessary function. <\/p>\n\n So a simple website that uses only the necessary features does not necessarily need a consent banner.<\/p>\n\n This is where it gets a little more complicated.<\/p>\n\n It’s not just Google Analytics that can send or retrieve information from a visitor’s device.<\/p>\n\n When you add third-party services to the website, tracking technologies may be included.<\/p>\n\n These may include, for example, analytics tools, advertising pixels, chat features, social media, videos, maps, or other third-party solutions.<\/p>\n\n The Agency for Digitization specifically points out that third-party tools and embedded content may collect information, even if the website owner does not necessarily receive the data themselves.<\/p>\n\n That is why the question is not just:<\/p>\n\n \u201cDo we have Analytics?\u201d<\/strong><\/p>\n\n It is:<\/p>\n\n \u201cWhat technologies are actually used on the website?\u201d<\/strong><\/p>\n\n That might be the most important part.<\/p>\n\n The Danish Data Protection Agency recommends that website owners be aware of which cookies and similar technologies their websites use.<\/p>\n\n This means that a cookie banner alone does not solve the problem.<\/p>\n\n If the banner says one thing, while the website is already sending data to various services before the user has made a selection, it doesn’t help much that the banner looks professional.<\/p>\n\n From a technical standpoint, a consent banner must also block the relevant technologies until the user has made a selection.<\/p>\n\n If the website uses non-essential technologies\u2014such as for visitor statistics, tracking, or personalized marketing\u2014the rules generally require informed consent. Users must be able to choose, and it must be possible to opt out. <\/p>\n\n This is where a properly set up consent solution makes sense.<\/p>\n\n Not because \u201cevery website has to have a banner.\u201d<\/p>\n\n But because that particular website uses technology that requires the visitor to make a choice.<\/p>\n\n There is also another option.<\/p>\n\n Before implementing a large-scale cookie setup, you might ask:<\/p>\n\n Do we really need all the tools we’ve put on the website?<\/strong><\/p>\n\n If a small business never opens its Analytics account, doesn’t use the data, and doesn’t run ads based on it, it’s worth considering why the tracking is there at all.<\/p>\n\n The Data Protection Authority also emphasizes the principle of not collecting more information than is necessary.<\/p>\n\n Sometimes, therefore, the best cookie setup isn’t a larger banner.<\/p>\n\n It’s a simpler website.<\/p>\n\n Maybe.<\/p>\n\n But not just because you have a website.<\/p>\n\n Instead, start by figuring out what the site actually collects and which services it communicates with<\/strong>.<\/p>\n\n Only then does it make sense to decide which solution is needed.<\/p>\n\n No Cookies, No Tears?<\/strong><\/p>\n\n Maybe.<\/p>\n\n But first, you need to make sure that there really aren’t any cookies\u2014or other tracking technologies\u2014hiding in the background.<\/p>\n","protected":false},"excerpt":{"rendered":" A cookie banner isn’t automatically required on all websites.
